

Electronic Documentation Retention: What Your Business Should Know
A recent Supreme Court ruling states that business will be required to "capture and preserve" all electronic data (including but not limited to email, instant messaging, and electronic documents) upon notification of a potential dispute for the purpose of further legal discovery. Noncompliant businesses will be subject to significant penalties.
The revised Federal Rules of Civil Procedure require businesses, aware of a pending dispute, to preserve all forms of electronic data and address electronic information preservation.
